Gide advises the search engine Liligo (eDreams ODIGEO group) in one of the very first damages actions in France under the Digital Markets Act (DMA).
Liligo Metasearch Technologies, S.A.S. is a French company recognised in the online travel sector, part of the European group eDreams ODIGEO. Liligo’s main activity is operating a metasearch engine that allows end users to compare in real time flight, hotel, car rental, and other travel service offers provided by hundreds of airlines, online travel agencies, and other third-party travel service providers.
Following the opening of a formal procedure in early 2024, the European Commission notified Alphabet in March 2025 of its preliminary findings, according to which certain features and functionalities of Google Search give preferential treatment to Alphabet’s own services for flight-related queries compared with competing services. This does not ensure the transparent, fair, and non-discriminatory treatment of third-party services as required under the Digital Markets Act (DMA). Once the preliminary findings are confirmed, the European Commission could adopt a decision finding Alphabet in breach and imposing a fine of up to 10% of its total global turnover.
Without waiting for the outcome of this procedure, expected in the coming weeks, Liligo has brought an action against Alphabet before the Tribunal des Activités Économiques de Paris to obtain the immediate cessation of the identified self-preferencing practices and compensation for the damage suffered.
