Gide assists its clients in pre-litigation and litigation matters, representing them before national and international jurisdictions alike.
- At the pre-litigation stage, our team mainly acts in the assessment of a claim’s legal risks and assists its clients in the management of the claim in itself, as well as in the implementation, as applicable, of alternative dispute resolution methods. We also act on risks arising from the drafting of contracts, in particular life insurance waiver risks
- At the litigation stage, our lawyers act before commercial, civil and criminal courts (ICC, CEFAREA), as well as before competition and supervisory authorities
As regards the insurance of individuals, we act in individual or group disputes concerning the underwriting, management and settlement of life insurance and health insurance contracts. We also manage a number of disputes regarding the application of life and reserve guarantees, as well as disputes relating to the civil liability of intermediaries in the subscription of unit-linked insurance policies.
In terms of general insurance disputes, our lawyers apply their skill in several fields of damage and third-party liability law (professional liability insurance, operations liability insurance, corporate officer liability insurance, civil liability insurance for faulty products), whether at the legal investigation stage or before the courts. Our team also comprises lawyers specialising in intermediation disputes (civil liability and financial guarantee of distributors) and in compensation for bodily injury.
Our Insurance team comprises lawyers specialising in construction insurance who act in disputes regarding the liability of construction companies and the insurance of construction risks (analysis of the nature of issues, identification of persons to receive compensation and of the legal basis of liability claims brought against the construction companies, determining damages). They represent clients before commercial, administrative, civil, criminal and arbitral courts, as well as in the context of court-ordered expert reports.
Gide’s specialised lawyers furthermore assist its clients in interpreting reinsurance treaties, as well as in disputes between reinsurers or between reinsurance and undertaking companies.
Finally, we act on disputes deriving from alleged unfair practices or anti-competitive behaviour in the insurance sector and assist our clients in their relations with national or European supervisory authorities, as well as in appeals against the opinions handed down by such authorities.
