The difficulties experienced by the financial sector in Europe over the past few years have resulted in a strengthening of the European regulation of securitisation transactions. An EU Directive has regulated capital retention requirements associated with securitisation transactions in Europe since 1 January 2011 and these regulations are currently undergoing modification with a view to rendering them more appropriate for application to different types of securitisation transactions, including managed collateralised loan obligation securitisations.
This Client Alert first summarises the existing regulatory texts, before examining the new provisions that are currently in the process of implementation.
