31 March 2008 - Gide Loyrette Nouel Paris advises France 3 in litigation against M5:

On March 21, 2008, the Paris Court of appeal confirmed the rulings of the summary proceedings of the Paris county court on February 9, 2007, and of the Paris commercial court on April 23, 2007, in a case opposing France 3 and the Japanese production company TOEI, with M5, a programmes sales company.

Taking into account the ban on the diffusion of the cartoon series Captain Flam, passed by the Judge of the summary civil proceedings, France 3 demanded in return a contractual guarantee by M5 to be put in place.

In the two judgements, the court noted the obviously irregular nature of the diffusion rights to the series yielded by M5 to France 3, and consequently ordered M5 to pay €100.000 excluding tax to France 3, as a reimbursement for the unexploited rights.  

During these proceedings, France 3 was represented by Gide Loyrette Nouel A.A.R.P.I. (Charles-Edouard Renault and Stéphanie Berland of the IP-TEC department).
